1. Acceptance of These Terms
By creating an account, accessing, or using L.O.S Farms (the "Service") — including the website, the game, the desktop launcher, the forums, the wiki, our Discord bot, the other L.O.S Games websites, and the L.O.S Marketplace — you agree to these Terms of Service ("Terms"), the User Agreement, the Privacy Policy, the Refund Policy, and the Copyright Policy, each of which is part of these Terms. If you do not agree, do not use the Service.
2. What L.O.S Farms Is
L.O.S Farms is an unofficial, volunteer-run community project that preserves the original Flash-based version of FarmVille, a game originally created and published by Zynga Inc. L.O.S Farms:
- is not affiliated with, endorsed by, sponsored by, or connected to Zynga Inc., Take-Two Interactive Software, Inc., Meta Platforms, Inc. (Facebook), Adobe Inc., or any of their affiliates or successors;
- is free to play: playing the games and using the community cost nothing. We never sell game currency, game items, or anything else from the games, and we don't show advertising. The only things we sell are optional, original L.O.S cosmetics for your profile and supporter memberships (see section 7);
- uses original game assets for historical preservation and nostalgia, without a license from the original rights holders. All FarmVille trademarks, artwork, and game content belong to their respective owners.
If you own rights in any content on the Service and have a concern, please see our Copyright Policy or use the contact form. We respond promptly and in good faith.
3. Eligibility and Accounts
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the permission of a parent or legal guardian who agrees to these Terms on your behalf.
You can create an account by signing in with Discord, or with an email address and password (you confirm the address with a link we send). Either way, you can add the other as a second way to sign in. You are responsible for activity on your account and for keeping your Discord account, email, and password secure.
One account per person. Do not create or use extra accounts ("alts"), and do not share, sell, buy, or transfer accounts. Staff may merge, reset, or remove accounts used to get around these Terms or to collect extra rewards.
4. Community Rules
When using the game, website, forums, chat, wiki, launcher, our Discord server, or our Discord bot, you agree not to:
- harass, threaten, or impersonate other players or staff;
- post illegal, hateful, sexually explicit, or otherwise harmful content, or anyone's private information;
- cheat, exploit bugs, or use automation, scripts, macros, modified clients, or other tools to gain an advantage — including to play Discord bot games or to open care package drops;
- use more than one account to collect rewards, care packages, or Farm Cash;
- try to access other accounts, the servers, or their data without permission, or disrupt the Service for others;
- advertise, spam, or offer anything connected to the Service for real money or other real-world value (other than through the L.O.S Marketplace itself).
Our Discord server and bot are also subject to Discord's Terms of Service and Community Guidelines.
5. Your Content
You keep ownership of what you post (forum posts, wiki edits, chat messages, profile details, and images). By posting it, you give L.O.S Farms a free, non-exclusive permission to store, display, and share it as part of the Service, and to keep wiki edits and forum history for the community. Only post content you have the right to share.
6. Moderation and Termination
Staff may remove content, adjust or reset in-game progress or currency, suspend, or permanently ban accounts that break these Terms or harm the community. Staff actions are recorded internally for accountability. You may stop using the Service at any time and delete your account from your account settings (Data & Account).
7. The L.O.S Marketplace and Memberships
The L.O.S Marketplace (at losgames.xyz) sells optional digital cosmetics for your L.O.S account: avatar frames, name effects, profile banners, profile effects, title plates, and emblems. They are original designs made by our own team.
- Cosmetic only. They change how your profile looks on L.O.S websites, forums, and chat. They never change a game, and we never sell Farm Cash, coins, game items, or anything else from the games, or anything that gives an advantage.
- A licence, not property. Buying an item gives you a personal right to use it on your L.O.S account while L.O.S runs. Items have no cash value and can't be sold, traded, or moved to another account.
- Gifts. You can buy an item or set as a gift for another L.O.S member. Once it's delivered it belongs to them, as if they had bought it. Gift messages must follow our rules like anything else you post.
- Limited items. Holiday items are only on sale during their holiday. If you buy one, you keep it all year.
- Prices are in US dollars and shown before you pay. Payments are handled by Stripe; we never see or store your card details. Items are added to your account as soon as your payment goes through.
- Memberships. L.O.S Supporter and L.O.S VIP renew every month until you cancel; Lifetime Supporter is a one-time payment. They include exclusive cosmetics, a Marketplace discount, and the monthly Supporter Drop, and are cosmetic only. Cancel any time from Manage membership on the Marketplace; your membership stays active until the end of the month you've paid for. Boosting our Discord server gives the free Server Booster membership while you boost.
- Refunds are covered by our Refund Policy.
- Closed accounts. If we close an account for breaking these Terms, its items and memberships end with it and aren't refunded, except where the law requires.
- Changes. The Marketplace may change, pause, or close. If it closes for good, we will say so in advance on our websites and Discord.
8. No Warranty
The Service is provided "as is" and "as available" by volunteers. We do not guarantee that it will be available, error-free, or secure, or that your progress will be preserved. The Service may change, pause, or shut down at any time, including if a rights holder asks us to. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
9. Limitation of Liability
To the fullest extent permitted by law, the people who operate L.O.S Farms are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, progress, or virtual items, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or zero dollars (US $0) if you haven't paid us anything, where the law allows.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and announce significant changes in the forums or on Discord. Continuing to use the Service after changes take effect means you accept the updated Terms.
